1. Our business policy
1.1 The Seller conducts its e-commerce business exclusively with respect to its end users who have reached the age of majority and who are "consumers".
1.2 When we speak of "consumer" we refer to any natural person who acts on umbertogiugliano.com for purposes not related to his or her own commercial, entrepreneurial or professional activity, if any. If you are not a "consumer," please refrain from entering into commercial transactions on umbertogiugliano.com.
1.3 In view of its commercial policy, the Seller reserves the right not to accept proposals of purchase orders from parties other than the "consumer" or otherwise proposals of purchase orders that do not comply with its commercial policy, such as, for example, proposals of orders for which there is a report, or suspicion, of fraudulent or illegal activities. In such cases, the Seller will notify the user of the rejection of the order proposal.
All order proposals transmitted to the Seller and returns made by users must also correspond to normal consumer needs. The Seller therefore monitors the number of order proposals transmitted and returns made.
1.4 These General Terms and Conditions of Sale govern exclusively the submission of order proposals for the purchase of products available on umbertogiugliano.com by the user and the acceptance thereof by the Seller.
1.5 On the other hand, the General Terms and Conditions of Sale do not regulate the provision of services or the sale of products by parties other than the Seller that are present on umbertogiugliano.com through links, banners or other hypertext links. We advise you, before placing orders and purchasing products and services from parties other than the Seller, to check their terms and conditions, because the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of electronic commerce transactions between users of umbertogiugliano.com and third parties.
2. Information directed to the conclusion of the contract with the Seller pursuant to Legislative Decree No. 70 of April 9, 2003.
2.1 In order to conclude a contract for the purchase of one or more products on umbertogiugliano.com, you must send electronically a purchase order proposal to the Seller by filling in the form available on umbertogiugliano.com and following the relevant instructions.
2.2 Before transmitting the proposed order, please remember to read carefully the General Conditions of Sale and theRight of Withdrawal Notice, print a copy through the print command and store or reproduce a copy for your personal use. In accordance with Article 51, paragraph 7, of Legislative Decree September 6, 2005, no. 206 (the "Consumer Code"), before transmitting your proposed order, we will provide you with a summary of the commercial and contractual conditions that will apply to your proposed order to purchase products and a summary of the information on the essential characteristics of each product ordered with its price (including all applicable taxes or duties), the means of payment that you may use to purchase each product, the delivery methods of the products purchased, the shipping and delivery costs as well as the references, geographical address and contact details of the Seller and the date by which the Seller, upon acceptance of your proposed order, agrees to deliver the goods. The Seller will also provide you with a summary of the terms and conditions for exercising your right of withdrawal. If applicable, you will be informed that, in case of withdrawal, you will have to bear the cost of returning the products. You will, in any case, be reminded of the existence of the legal guarantee of conformity of the products, you will be provided with the contact details of our after-sales service and we will remind you of the possibility of using the conciliation service, independent and institutional, c.d. "RisolviOnline", provided by the Chamber of Arbitration of the Chamber of Commerce of Milan as well as the possibility of using the platform for alternative dispute resolution, accessible on the site http://ec.europa.eu/odr, made available by the European Commission.
2.3 On the order proposal confirmation page, which contains a reference to the General Terms and Conditions of Sale and the Right of Withdrawal Policy, we will provide you with summary information about the essential characteristics of each product indicated of your order proposal, the price (including all applicable taxes or duties) and the shipping costs (including any additional costs incurred by you for having chosen a different and/or faster type of shipping and delivery than the standard one).
2.4 Transmission of the order proposal to the Seller constitutes a binding purchase proposal for you. You will therefore be required to identify and correct any data entry errors before transmitting your order proposal.
2.5 Once your order proposal has been transmitted, you will receive an automated email from the Seller confirming receipt of your order proposal. Receipt of the aforementioned email does not constitute acceptance of your proposed order.
2.6 The contract is concluded when your order proposal is accepted by the Seller. The Seller will send you a second email to confirm acceptance of your order proposal and successful shipment of the products. This email will also contain a copy of the General Terms and Conditions of Sale and the Right of Withdrawal summary document.
2.7 The order proposal transmitted to the Vendor will be stored in our database for the period of time required to process order proposals accepted by the Vendor and otherwise within the terms of the law. You will be able to access your order proposal form by consulting the appropriate personal account section on umbertogiugliano.com.
2.8 The language available to conclude the contract with the Seller is Italian.
2.9 The Seller may not accept your proposed purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailability of products.
In these cases, we will inform you by e-mail that the contract is not concluded and that the Seller has not accepted your proposed purchase order specifying the reasons. If the products, presented on umbertogiugliano.com, are no longer available or on sale at the time of receipt or processing of your proposed purchase order, it will be the responsibility of the Seller to notify you, promptly and in any event within thirty (30) days from the day following the day on which you have transmitted your proposed order to the Seller, of the unavailability of the products. If you have already paid the price for the products, the Seller will refund, without undue delay, what you have already advanced and the contract of sale will be considered terminated.
The Seller also reserves the right not to accept proposals for purchase orders in the cases referred to in paragraph 1.3 above.
2.10 We remind you that, by telematically transmitting your order proposal, you unconditionally accept and undertake to observe, in your dealings with the Seller, these General Conditions of Sale. If you do not agree with any of the terms set forth in the General Conditions of Sale, please do not submit your order proposal for the purchase of products on umbertogiugliano.com.
2.11 By submitting your order proposal you confirm that you also understand and accept, the further information contained in umbertogiugliano.com, also referred to through links, including the Privacy Policy and the Notice of Right of Withdrawal.
3. Guarantees and indication of product prices
3.1 The Seller sells only premium and luxury brand products. These products are purchased directly by the Seller from fashion houses, manufacturers and retailers carefully selected for their rigorous quality controls.
3.2 The Seller does not sell used, irregular or substandard products that are inferior to the corresponding standards offered in the market. Only vintage items that are presented in the specific section of umbertogiugliano.com, due to their particular nature, may be used and/or in a condition of obvious wear and tear. In the description of each vintage product umbertogiugliano.com will take care to specify the condition of the garment presented if it differs from the standards offered on the market.
3.3 The essential characteristics of the products are presented on umbertogiugliano.com within each product sheet. However, the images and colors of the products presented on umbertogiugliano.com may not correspond to the real ones due to the effect of the Internet browser and monitor used.
3.4 Product prices may be subject to updates. Make sure of the final sale price before submitting the relevant order proposal. In the event that there is a recognizable error in the indication - by Umberto Giugliano Boutique - of the price of a product or in the calculation of the amount requested in payment, Umberto Giugliano Boutique will not accept the order proposal and will contact the user in order to offer the opportunity to transmit the order proposal for the purchase of the product(s) at the correct price.
3.5 Purchase requests from countries not included among those displayed on the splash page may not be accepted by the Seller.
3.6 All products carry identification tags.
3.7 All products sold by Umberto Giugliano Boutique are covered by the legal warranty of twenty-four (24) months for conformity defects, in accordance with applicable law. The lack of conformity of the product must be communicated to the Seller within two (2) months from its discovery. The lack of conformity can be reported to the Seller by contacting Customer Service. In case of lack of conformity you have the right to request repair or replacement of the product. If the above remedies are not possible or are excessively onerous, you will be entitled to a reduction of the price paid or termination of the sales contract, pursuant to Article 130 of the Consumer Code.
4. Payments
4.1 For payment of the price of the products and related shipping and delivery costs you may follow one of the methods indicated in the order proposal form. Under no circumstances will you be charged any costs in excess of those actually incurred by the Seller, in relation to the payment instrument you have chosen.
4.2 In case of payment by credit card, the financial information (for example, the number of the credit/debit card or the date of its expiration) will be forwarded, via encrypted protocol, to Banca Intesa San Paolo or other banks, which provide the relevant remote electronic payment services, without third parties being able, in any way, to access it. Such information, moreover, will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relevant refunds in the event of any returns of products, following the exercise of your right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on umbertogiugliano.com. The price for the purchase of products and shipping costs, as indicated in the order proposal, will be charged to your bank account when the purchased products are shipped.
4.3 If you buy with Scalapay you receive your order immediately and pay in the number of installments you have chosen. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and you authorize such assignment.
5. Shipping and delivery of products
5.1 To learn about the specific shipping and delivery of products, please access the Shipping, Delivery and Returns section. Please pay attention to what is stated in this section because the information contained therein forms an integral and substantial part of these General Terms and Conditions of Sale and, therefore, shall be deemed to be fully known and accepted by you at the time of transmission of the order proposal.

7. Right of withdrawal
7.1 You have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within one hundred (30) days, starting from the day of receipt of the products purchased on umbertogiugliano.com.
7.2 You may withdraw from the contract concluded with the Seller using the following procedure:
Inside the package you will find a Return and Exchange Instruction Form.
To request return authorization, you must send a request with the subject line RETURN AUTHORIZATION REQUEST to the e-mail address hello@umbertogiugliano.com within thirty (30) days starting from the receipt of the delivery of your order.
Once you receive the return authorization code, you will have to return the products to the Seller by delivering them to the courier for shipping which will be free of charge if you are shipping from 'Italy and a fee, with the cost of shipping borne by you, if you ship from abroad.

7.3 Once you have exercised your right of withdrawal from the contract, you must return the products to the Seller by delivering them to the courier for shipment, according to the procedures specified in the section: Shipping Information, Delivery and Payments, within thirty (30) days starting from the receipt of the delivery of your order.
7.4 The right of withdrawal - in addition to compliance with the terms and conditions described in the preceding paragraphs - shall be deemed to have been properly exercised if the following conditions are also fully complied with:
- The return will be accepted only if the tag and the security seal are perfectly intact. Under no circumstances will returns be accepted with the tag and security seal cut, broken, detached, removed or tampered with.
- Products to be returned must not have been worn, ironed, washed, processed or damaged in any way.
- All product labels, whether fabric or hanging, must necessarily be intact and under no circumstances removed from the item.
- Products must be returned in their original packaging (if you want to return a kit, you must return all the items in it).
- Products must necessarily be returned in the same condition in which they were shipped to you and must be packed and packaged appropriately.
- The products to be returned must be physically delivered to the Courier no later than fourteen (14) days beginning when you have notified the Seller of your decision to withdraw from the contract;
- The Customer who wishes to make a change in size, color or item, of equal or greater amount must submit the return procedure and place a new order at giuglianoumberto.com
- Pursuant to Article 59 of the Consumer Code, the right of withdrawal is also excluded if you have purchased custom-made or personalized products or sealed goods that are not suitable for return for hygienic or health protection reasons and have been opened after delivery.
7.5 The Seller will make the necessary investigations in order to verify the conformity of the returned products with the conditions and terms stated in paragraph 7.4 and above.
If the right of withdrawal is exercised by following the procedures and terms indicated above, the Seller shall send you, by e-mail, the relevant confirmation of acceptance of the products thus returned and refund any sums already collected for the purchase of the products in accordance with the procedures and terms provided.
7.6 The sums will be refunded to you in the shortest time possible and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures, once we have verified the correct execution of the terms and conditions indicated above.
7.7 If the terms and conditions for the exercise of your right of withdrawal, referred to in the letters of paragraph 7.4 above, or in the case referred to in Article 59 of the Consumer Code, are not respected, you will not be entitled to a refund of any amounts already paid to the Seller. The Seller will notify you by e-mail of the non-acceptance of your return. Within 14 days of receiving the e-mail from the Seller, you may elect to re-obtain, at your expense, the products in the state in which they were returned to the Seller, by notifying the Seller in the manner that will be communicated to you. Otherwise, the Seller may retain the products, in addition to the amounts already paid for their purchase.
The Seller assumes no responsibility for products returned in error or for items forgotten in packages or returned products.
8. Timing and method of refund
8.1 Whichever method of payment you used, the refund due, in full or in part, shall be activated by the Seller, as soon as possible and in any case within one hundred (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verifying the proper execution of your right of withdrawal and checking the returned products.
8.2 The Seller shall make the refund using the same means of payment that you used to purchase the returned products, unless you have expressly agreed with the Seller to use a different means of payment and provided that you do not incur any additional costs as a consequence of the refund. If there is no correspondence between the recipient of the products indicated in the order proposal and the person who made the payment of the sums due for their purchase, the refund of the sums, in case of exercise of the right of withdrawal, will be carried out by the Seller, in any case, towards the person who made the payment.
8.3 Please note that the value date of the re-credit is the same as that of the debit; consequently, you will not suffer any loss in terms of bank interest.

10. Applicable Law and Dispute Resolution
10.1 Without prejudice to the application of the mandatory rules of European derivation for the protection of the consumer, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and Legislative Decree No. 70 of 9 April 2003 ("Implementation of Directive 2000/31/EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce").
10.2 Please also note that the European Commission provides a platform for out-of-court alternative dispute resolution, which can be accessed at http://ec.europa.eu/odr.
10.3 All disputes relating to the purchases and/or these General Terms and Conditions of Sale shall be settled by the Court of the consumer's place of domicile or residence under applicable law or, at the consumer's option, by the Court of Nola.
11. Modification and updating
11.1 The General Conditions of Sale shall be amended from time to time by the Seller also in consideration of any regulatory changes. The new General Conditions of Sale shall be effective from the date of publication on umbertogiugliano.com.
12. GIFT CARDS.
Virtual Gift Cards are available exclusively online at UMBERTOGIUGLIANO.COM.
The Virtual Gift Card is valid for 6 months from the date the confirmation email is sent, can be used for one or more orders and can also be spent on orders with a value greater than the Virtual Gift Card.
Virtual Gift Card purchases must be made in the same currency in which the card was issued.
The Virtual Gift Card code will be sent only to the specified email address. UMBERTOGIUGLIANO.COM will not be responsible if Virtual Gift Cards are sent to an incorrect or incomplete address provided by the purchaser.
The Virtual Gift Card will be sent after payment has been made.To allow for shipment within a faster time frame, the purchase must be made with an immediate payment system such as credit card. Virtual Gift Cards purchased by bank transfer will be sent to the recipient after payment is received by UMBERTOGIUGLIANO.COM
Codes cannot be combined with other Virtual Gift Card codes.
The Virtual Gift Card cannot be used to purchase another Virtual Gift Card and is not redeemable for cash or credit. The customer may request a refund of the Virtual Gift Card purchased, if unused, within 14 days of purchase.
Orders placed via Virtual Gift Card may be returned; the amount for returned merchandise will be credited back to the Virtual Gift Card.
UMBERTOGIUGLIANO.COM reserves the right to refuse orders placed through the use of Virtual Gift Cards that show signs of duplication or fraudulent use.
